India: Violators on medical staff will face up to seven years in prison

In India, the central government introduced a nearly-century-old ordinance, amending the ordinance to introduce severe penalties for torturers on medical staff to curb the growing violence against doctors and medical staff on the frontline.


The Indian government has introduced the aforementioned special ordinance at a time when violence against members of doctors and medical staff is being seen throughout India during the outbreak of the Corona virus.

Against the growing violence against medical staff and doctors a few days ago, the Indian Association of Doctors also threatened the government that the medical staff would quit if medical staff were not provided.

In view of the increasing violence against doctors and medical staff, the Central Government of India amended the 123-year-old pandemic ordinance and amended the new amendment ordinance.
The Indian newspaper India Today reported in its report that the central government has prepared an amendment ordinance (Disease Disease Act 2020) against the torture of doctors and medical staff and its central cabinet also approved.

The bill will now be enacted after the signing of the President and Prime Minister, under which medical personnel and doctors will be punished for seven years and fined up to Rs 7 lakh.

According to the report, different types of penalties have been proposed against those who tortured doctors and medical staff under the Disease Disease Act and the Act's punishments are divided into 2 main sections.

The above act has proposed a minimum sentence of three months and a fine of Rs 50,000 while imprisonment of a maximum of 7 years and a fine of Rs 7 lakh while distributing in general violence and assault, including extreme forms of torture and assault. ۔

Under the Ordinance Act, those convicted of minor acts of violence and assault can be sentenced to a minimum of 3 months and a maximum of 5 years, or a fine of at least 50 thousand or a maximum of 2 million.

Or both sentences can be pronounced.

Similarly, those involved in severe violence and assault can be given a minimum of 6 months imprisonment and a maximum of 7 years imprisonment while a minimum of one lakh and a maximum of Rs 7 lakh can be fined or both.

After the ordinance was approved by the cabinet, Union Minister Parkash Javadekar said that the ordinance would be signed by the President and the Prime Minister till tomorrow or tomorrow after which the ordinance would be implemented.

He said that in case of any case, the case of those involved in the attack will be completed within 30 days while the person involved will be sentenced within one year.

It is to be noted that in other countries besides India, strict ordinances have been imposed following complaints of violence against doctors and medical staff during corona virus.

Apart from India, countries like the Philippines and the United Kingdom, where strict torture laws have been enforced on torture victims, there have also been strict laws on lockdown violations during the Corona virus.

In Pakistan too, arrests and imprisonment penalties for lockdown violations are enforced, while those who torture medical staff have strict penalties.
